This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD website, Procurement Notices (www.ebrd.com) on 10th Feb 2014., procurement Ref. 7275-GPN-39990.

Međimurske vode d.o.o., hereinafter referred to as "the Employer", intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of The North Western Regional Waste Water Project.

The Employer now invites sealed tenders from contractors for the following contract to be funded from part of the proceeds of the loan:

Construction of sewerage system Novo Selo na Dravi (including three pumping stations - PS1 Totovec, PS2 Šandorovec and PS3 Novo Selo na Dravi, connecting pipes and collectors) further referred as "The Works", the length of gravitation and pressure sewerage system is in the total of 17.333,00 m, The Works should be executed in villages Novo Selo na Dravi, Totovec, Kuršanec and Šandorovec, The Works shall comprise (inter alia) the mobilization and demobilization of staff and equipment, provision of site installations, provision of temporary facilities during construction, housing for Contractor's staff, provision of all site offices and vehicles including running costs, purchase, receipt, storage of all material required for the Works, the preparation of working drawings (construction design/shop drawings), setting out, preparation of "As built Design", testing and commissioning of those Works, correction of any defects until the end of the Defects Notification Period (12 months). Expected completion date is within 18 months from the Commencement Date.

Tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms from any country.

To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:

• no consistent history of historical non-performance and/or litigation awards against the Tenderer or any partner of a joint venture

• positive financial results for the last three years

• minimal annual turnover of 4.000.000,00 EUR for last three years

• access to the funds (the Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of four (4) months, estimated as not less than 300.000,00 EURO)

• experience under contracts in the role of contractor or management contractor for the last five (5) years prior to the tender submission deadline, and with activity in at least nine (9) months in each year

• minimal two projects similar in the size executed in last five years (the Tenderer shall demonstrate that it has successful experience as prime contractor and has executed at least two (2) projects of a nature and complexity comparable to the proposed contract within the last five (5) years, each project with no less than 2.000.000 EURO (two million EURO) with issued Employer's Certificate.)

• the Tenderer shall demonstrate that it has successful experience as prime contractor in the construction in a projects of a nature and complexity comparable to the proposed contract of at least 10.000,00 meters (ten thousand meters) of sewerage network within the last five (5) years with issued Employer's Certificate

• available qualified staff

• availability of equipment for contract execution (conformity of equipment)

• conformity of material and services (the Tenderer that does not manufacture or produce the submerged wastewater pumps it offers to supply shall submit the Manufacturer's Authorization, tenderer must submit relevant catalogues / instructions for installations / ISO 9001 certificate for the following items - all types of sewerage pipes, all types of manholes and submerged wastewater pumps and for all valves and covers and electromagnetic flow meter it offers to supply, tenderer must submit relevant proofs of material quality as required by Croatian legal regulations)

Upon receipt of appropriate evidence of payment of the non-refundable fee, the documents will promptly be dispatched by courier; however, no liability can be accepted for their loss or late delivery. In addition, if requested, the documents can be dispatched electronically after presentation by the prospective tenderer of an appropriate evidence of payment of the non-refundable fee. In the event of discrepancy between electronic and hard copies of the documents, the hard copy shall prevail.

All tenders must be accompanied by a tender security of 50.000,00 EUR (fifty thousand) or its equivalent in a convertible currency.

Tenders must be delivered to the office at the address below on or before 23rd June 2014, at 10:00 am, at which time they will be opened in the presence of those tenderers' representatives who choose to attend.

Costs incurred by the tenderer in preparing and submitting the tender proposals will not be reimbursed.
