Invitation for Expression of Interest
Bosnia and Herzegovina is currently conducting a procedure of signing a loan agreement with European Investment Bank (hereinafter EIB) to finance priority sections of the motorway on the route of Pan European Corridor Vc through Bosnia and Herzegovina. The Federation of Bosnia and Herzegovina (the beneficiary) intends to apply part of the proceeds of this loan toward the cost of civil works and consulting services, to be procured for the section of motorway from Tunnel Kvanj to Buna.
The construction of the motorway section from Tunnel Kvanj to Buna will be carried out within the following contract:
— contract Tunnel Kvanj — Buna in total length of 5,25 km will be financed from the loan agreement signed with EIB.
The subject of this invitation for expressions of interest are consulting services for technical assistance to the PIU of the Public company Motorways of the Federation of Bosnia and Herzegovina Ltd. Mostar for the project on Corridor Vc, section Tunnel Kvanj-Buna, Contract no. JPAC 1079-E566-19 which shall be funded from the proceeds of EIB loan.
Public company Motorways of the Federation of Bosnia and Herzegovina Ltd Mostar (the employer), on behalf of the beneficiary, intends short-listing consulting firms to provide technical assistance to the project implementation unit of the above mentioned contract.
The FIDIC conditions of contract for plant and design-build for electrical and mechanical plant, and for building and engineering work, designed by the contractor, First Edition 1999 will be used for the design and civil works contracts.
The overall objective of the management consultant services to the PIU is to ensure professional, efficient and optimal coordination of activities of parties involved in the project.
The consultant will help the PIU, add resources to the organization and give assistance in ensuring that suitable control and organizational systems are put in place to effectively manage, in terms of time and finances, the project financed by the IFIs. A major goal for the successful realization of this project is assistance in daily management of the project under all its segments and in particular claim management, liaison with designers, reviewers, supervising engineers, contractor and responsible representatives of the PIU, risk management, advising on specific technical issues, as well as assistance in cooperation with the IFIs. The consultant will add resources and expertise to manage effectively a complex project with many interested parties.
Also, the specific objective of the services is to assist the PIU with contract implementation, administration and supervision to ensure that the program of works is efficiently and quickly implemented and completed in line with contractual conditions and technical description, and to support introduction of contemporary transportation technologies. It will also help in producing more detailed reporting lines to lenders.
The consultant is expected to play a proactive role in the implementation of the project, to initiate and coordinate all activities among other participants and to facilitate the employer’s decisions in order to achieve the project goals.
Main duties of the Consultant can be summarized as follows:
— to provide the needed technical assistance to the PIU, undertaking the management of the project in its sections,
— to supervise and monitor the implementation of the project related contracts,
— to liaise with the counterparts, consultants, contractors and IFIs,
— to prepare project implementation reports to all stakeholders,
— to prepare the supporting documents necessary to the employer’s decisions with respect to the project management,
— to prepare reports and documentary evidence to seek non-objection from the lenders to the different procurement phases,
— maintain detailed records to track costs, dates of completion, procurement procedures, legal actions, environmental and social aspects related to the implementation of each project components.
Status of selection process: interested firms are hereby invited to submit their expressions of interest. This Invitation shall be followed by a short-listing of consulting firms and the short-listed firms will be formally invited to submit proposals.
Assignment start date and duration: the assignment is expected to start in September 2019 with an estimated duration of 39 (3+36) months and defects notification period of 24 months.
Maximum budget available for the assignment: 800 000 EUR.
The consultant must determine whether any indirect taxes/VAT are chargeable on the proposed services and state the basis for such. If any indirect taxes/VAT are payable, the Client will have to pay indirect taxes/VAT element to the services directly to the consultant unless otherwise agreed.

Eligibility restrictions: the invitation for expressions of interest is open to firms and joint ventures from all countries. Pursuant to its Sanctions Policy, the Bank shall not provide finance, directly or indirectly, to or for the benefit of an individual or entity that is subject to financial sanctions imposed by the EU, either autonomously or pursuant to the financial sanctions decided by the United Nations Security Council on the basis of article 41 of the UN Charter.
Consultant profile: the employer is seeking for a skilful and experienced Consultancy firm/JVCA who will be able to exercise the role of the technical assistance consultant and capable to ensure successful project implementation and completion. A consulting firm shall be engaged for this assignment and is expected to procure the services of a suitable multidisciplinary team of internationally experienced experts.
The consultant shall simultaneously comply with the following minimum criteria:
(a) the average annual turnover of the applicant for the past 5 years (2014-2018) must exceed 2 500 000 EUR;
(b) the audited financial statement and balance sheets for the past 5 years (2014-2018) must demonstrate the soundness of the applicant’s financial position, showing long-term profitability. Consistent losses or a risk of insolvency shown in the accounts may be cause for the disqualification of the applicant;
If the consultant is not yet able to provide the audited financial statement for 2018, he shall submit the following:
— excerpt with the provisions from the relevant law or bylaw(s) which clearly address the requirements regarding the deadlines for preparation and submission of official financial statements to the authorities, by which the consultant will prove that he was unable to provide official financial statements for the full 2018-year due to the cause which is beyond his control,
— any available format of financial statements (part of the management reports, accounting reports, quarterly or mid year performance reports, etc.) from which it is possible to make a full insight in relevant financial indicators and draw conclusion on consultant 2018 financial performance.
(c) the applicant has successfully completed (i.e. provisional acceptance or defects liability certificate issued) as sole consultant, lead partner or partner in JVCA in the past 5 years, at least 2 major similar projects in motorway/expressway works as FIDIC Engineer with consultancy services value of 2 500 000 EUR per project or technical assistance/project management consultant with consultancy services value of 600 000 EUR per project.
In case that referenced projects do not include design/review services, the applicant must demonstrate successful experience in motorway/expressway design in at least one project with value of not less than 600 000 EUR.
(d) in case of JV or Consortium, the Leading Company shall meet not less than 60 % and each of the partners shall meet not less than 40 % of the qualifying financial criterion (a) given above.
In terms of experience, each of proposed projects must have values as required in criterion (c).
Individual partners must each satisfy the requirements for soundness of financial position.
Interested consulting firms must provide information indicating that they are qualified to perform the services as follows:
(a) letter of application (signed by authorized person);
(b) company profile in accordance with Form ELI-1: applicant’s information sheet;
(c) applicant’s average annual turnover for the previous 5 (five) years (2014-2018) in accordance with Form FIN-2: Average Annual Turnover. Amount of annual turnover per year shall be presented as total revenue from the income statements;
(d) audited financial statement and balance sheets for the past 5 years (2014-2018), or if not required by the law of the applicant’s country, other financial statements acceptable to the employer, for the last five (5) years to demonstrate the soundness of the applicant’s financial position, showing long-term profitability; in case that the auditing of financial statements is not required by the law of the applicant’s country, the applicant is required to submit financial statements and document, i.e. excerpt from the relevant law or similar, which proves that the applicant is not obliged to audit the financial statements;
(e) applicant’s general experience (details of experience and description of assignments undertaken in the previous 5 (five) years) in accordance with Form EXP-1: General Experience and Form EXP-2: Specific Experience. Certificates of completion signed by relevant Contracting Authorities for at least 2 major similar projects presented shall be submitted;
(f) in case of JV or Consortium, form of association (sub-contractor/joint venture) for the execution of the contract, if the case may be, and the lead company in accordance with the Form ELI-2: JVCA structure and Form ELI-3: JVCA Information Sheet. The same information and documentation as for the lead company shall be requested for the associated company/companies;
(g) CVs (max. 2 pages each) of key staff who could be available to work on the assignment, clearly showing that their experience covers the main works activities above, in accordance with Form PER-1: Personnel Capabilities Form and Form PER-2: Resume of Proposed Personnel.
The consultant is free to determine the relevant key experts at EoI stage and propose their CVs. However, at the RfP stage, at least the following key experts will be required from the Consultant: team leader, claim expert, tunnel engineer and bridge engineer.
(h) a list of ongoing contracts in accordance with Form FIN-4: Current Contract Commitments/Services in Progress.
The applicant is expected to examine all instructions, forms, terms and information in the invitation for expression of interest. Failure to furnish all information or documentation required by the invitation for expression of interest may result in the rejection of the application.
One original and one copy of the above information (which should not exceed 25 pages excluding CVs and copy of financial statement) in English language, plus one copy in local language (Bosnian, Croatian or Serbian) should be submitted to the address below, in an envelope marked “Expression of Interest in Consulting services for technical assistance to the PIU of the Public company Motorways of the Federation of Bosnia and Herzegovina Ltd. Mostar for the project on Corridor Vc, section Tunnel Kvanj-Buna” not later than 29.4.2019, 12:00. (Local time).
Documents received after this date may be rejected and returned unopened upon written request and at the applicants cost.

Short Description of the project
The Tunnel Kvanj – Buna section starts at km 9+125 at the entrance portal of Tunnel Kvanj, continue within the viaduct “Rotimski potok”, leads through slope of “Gubavice” and ends at km 14+380 in the area of “Stanojevići”. Tunel Kvanj is a twin tube tunnel. Right tunnel tube, length 2 645 m, begin on chainage km 9+732 and left tunnel tube, length 2 720 m, begin on chainage km 9+750. Viaduct “Rotimski potok” crosses over creek “Rotimski potok”. The left viaduct is from 12+500 to 12+810 of the left axis and the right viaduct is from 12+445 to 12+775 of the right axis of the motorway. Both viaducts are designed as continuous prestressed concrete structure with spans 88+134+88=310 m for the left and 98+134+98=330 m for the right viaduct. On this section there is overpass Rujevice at chainage 14+197 and allows communication between neighbouring settlements. The overpass structure is designed as shallow arch with total span of 44 m and rise of 6,5 m. As part of the project, construction of the connecting road is foreseen. It is designed as 2 – way traffic road, length 1 414 m. This road will be used as a connection of the main road M17.3 in the Hodbina village, with the motorway section Tunnel Kvanj – Buna.
