CORRIGENDUM No. 4 to Guidelines for grant applicants

The following sections of the Guidelines for grant applicants are amended as follows:
(1) In order to be eligible for a grant, the lead applicant must:
- be a legal person and
- be non-profit-making and
- be effectively established in1 either Bosnia and Herzegovina or Montenegro, and
- be directly responsible for the preparation and management of the operations with the co- applicant(s) and affiliated entity(ies), not acting as an intermediaiy, and
- be a specific type of institution or organisation such as (but not limited to):
- For Lot 1: business associations, business development organisations, employment offices, social and economic development departments in regional and local govemments, centres for social welfare, high eđucation institutions, vocational education and training institutions, social partners and civil society organisations.
- For Lot 2: organisations responsible for maintenance and development of natural and cultural heritage, tourism development organisations, local and regional govemments.
(2) Potential applicants may not participate in calls for proposals or be awarded grants if they are in апу of the situations listed in section 2.3.3 of the Practical Guide;
In Аппех A.2, section 5 (‘đeclaration by the lead applicant’), the lead applicant must declare that the lead applicant himself, the co-applicant(s) and affiliated entity(ies) are not in апу of these situations.
To be determined on the basis of the organisation’s statutes that should đemonstrate that it has been established by an instrument govemed by the national law of the country concemed and that its head office is locateđ in an eligible country. In this respect, апу legal entity whose statutes have been established in another country cannot be consideređ an eligible local organisation, even if the statutes are registered locally or a ‘Memorandum of Understanding’ has been concluded.
The lead applicant must act with co-applicant(s) as specified hereafter.
If awarded the grant contract, the lead applicant will become the beneficiary identified as the Coordinator in Аппех E3hl (Special Conditions). The Coordinator is the main interlocutor of the Contracting Authority. It represents and acts on behalf of апу other co-beneficiary (if апу) and coordinate the đesign and implementation of the action.
Co-applicant(s)
The applicant must act with at least one co-applicant as specified hereafter.
Co-appHcants participate in designing and implementing the action, and the costs they incur are eligible in the same way as those incurred by the lead applicant.
If the applicant is effectively established in Bosnia and Herzegovina, at least one co-applicant must be effectively established in Montenegro, and viče versa.
CBC partners must carefully bear in mind the most appropriate conditions to ensure an intra-project efficient coordination when deciding on this. The number of partners and the composition of the partnership should be coherent with the envisaged objectives and activities of the operation.
In genuine cross-border operations, the applicant and co-applicant(s) shall cooperate in the development and implementation of operation. In addition, they shall cooperate in either the staffmg or the fmancing of operation or both (see section 2.1.4 below).
Co-applicants must satisfy the eligibility criteria as applicable to the lead applicant.
Co-applicants must sign the mandate in Аппех A.2., section 4.
If awarded the grant contract, the co-applicant(s) will become beneficiary(ies) in the action (together with the Coordinator).
The lead applicant and co-applicant(s) must represent different legal entities.
Ali other terms and conditions of the Guidelines for grant applicants including previous Corrigenda under this Call for Proposals remain unchanged.
