The holder of the public-procurement contract shall be obliged to carry out the planned works within 9 (nine) calendar months. The deadline for carrying out the works begins on the day when the holder of the contract is initiated into the works.

III.1)Conditions for participation

III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers

List and brief description of conditions:

As evidence for fulfillment of the criteria for the ability to perform a professional activity, the economic operator submits:

— in order to prove the ability to perform a professional activity, the economic operator shall submit a certificate for registered activity as evidence that it is registered as a natural or legal person to perform the activity related to the subject matter of the public procurement contract or evidence that it belongs to an appropriate professional association in accordance with the regulations of the country where it is registered,

— The economic operator is obliged to submit a License B for a Contractor of second category constructions in accordance with the Law on Construction ("Official Gazette of the Republic of Macedonia" number 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 132/16 and 35/18).

III.1.2)Economic and financial standing

List and brief description of selection criteria:

2.4.3 The economic operator shall prove the fulfilment of the minimum requirement of sub-section 2.4.1 or 2.4.2 by submitting:

— balance sheet report certified by a competent authority, or revised balance sheet or excerpts from the balance sheet report in cases when the publication of the balance sheet is prescribed by law in the country where the economic operator has been registered,

— statement of the overall turnover of the enterprise (data from the balance sheet issued by a competent authority, or revised balance sheet) and, where appropriate, from the turnover in the field covered by the public procurement contract, mostly for the last 3 financial years for which such information is available, depending on the date on which the enterprise was established or started its operation, and depending on the availability of such information.

Minimum level(s) of standards possibly required:

— minimum total income of 95 000 000,00 MKD in the last 3 financial years in aggregate, for which information is available.

III.1.3)Technical and professional ability

List and brief description of selection criteria:

2.5.2 The economic operator shall prove the fulfillment of the minimum requirements as referred to in sub-section 2.5.1 by submitting:

— a reference list of works carried out in the last 5 years by submitting certificates confirming satisfactory performance of the most important works, including the value, time and location of carrying out the works and indications confirming that the works have been carried out in accordance with the rules of business operations and properly completed in accordance with point 2.5.1 indent 1,

— a statement for engaged technical personnel, regardless of whether they directly belong to the economic operator, with attached authorizations in accordance with point 2.5.1 indent 2,

— a statement for employed or engaged at least 1 (one) professional person for safety at work, with attached certificate for passed professional exam in accordance with point 2.5.1 indent 3,

— economic operator shall enclose a statement that it has at its disposal the necessary technical equipment and attached valid registration document for a dump truck in accordance with point 2.5.1 indent 4,

— information on the elements of the contract that the economic operator intends to subcontract to a subcontractor, whereby the economic operator must state in its offer information about the part of the contract that it intends to subcontract to subcontractors (firm, registered office, taxpayer number and alike).

Minimum level(s) of standards possibly required:

2.5 Technical or professional capability

2.5.1 In order to qualify as capable to perform the relevant public procurement contract in terms of its technical or professional capability, the economic operator shall meet the following minimum requirements:

— at least 3 (three) realized contracts for same or similar works carried out in the last 5 (three) years. Minimum value of at least 1 (one) signed and realized contract for same or similar work carried out is 30 000 000,00 MKD, including VAT,

— economic operator shall have at least 10 (ten) employees or engaged persons, including at least: 2 (two) engineers with an Authorization B for a performance engineer in the field of civil engineering and building construction,

— professional person for safety at work with a certificate for passed professional exam,

— the economic operator shall have at its disposal: 1 (one) excavator with a deep bucket with a capacity of 0,6-1,0 m³, 1 (one) pick hammer, 1 (one) movable compressor, 1 (one) vibrator-roller, 1 (one) vibrator frog compactor, 1 (one) poker vibrator and 1 (one) dump truck with the minimum capacity of 8 m³.

The appeal shall be submitted within eight days starting from the day of:

— publication of the contract award notice with reference to the data, actions or failure to undertake actions related to the notice,

— opening of the tenders reference to the data, actions or failure to undertake actions related to the tender documentation, that is, the tender opening procedure expiry of the timeframe for adoption of a decision for selection or cancellation of the procedure pursuant to Article 162 Paragraph 2 of the Public Procurement Law regarding the failure to make a decision for selection or cancellation of the procedure in the relevant timeframe,
