INSTRUCTIONS TO TENDERERS
PUBLICATION REFERENCE : MIGRAO-010-24
By submitting its tender, the tenderer accepts the entirety, without restriction, of the general and special conditions governing this contract as the sole basis for this tender procedure, regardless of its own conditions of sale, which it declares to waive.
Tenderers are deemed to have carefully examined and complied with all forms, instructions, contractual provisions and specifications contained in these tender documents.
Any tenderer who fails to provide all the necessary information and documents within the required time will have its tender rejected. No reservation made in the tender in relation to the tender documents may be considered; any reservation may result in the immediate rejection of the tender without further evaluation.
These Instructions to Tenderers set out the rules for the submission, selection and implementation of contracts under this Invitation to Tender, in accordance with the provisions of the Civipol Guide to Procurement Procedures, which applies to this Invitation (available on the Internet at the following address https://www.civipol.fr/en/tenders.
1. Services to be provided
1.1 Subject of the contract is the supply, delivery, assembly, concreting and connexion by the contractor of prefabricated/containerised modules:
1.1.1 Lot 1: border crossing elements in Velika Kladuša Border Police Unit in Hadžin Potok, Bosnia.
1.1.2 Lot 2: Border crossing elements in Velika Kladuša border police unit in Zagrad, Bosnia. DDP1 , as well as the implementation period in days, in accordance with the contract notice.
1.2 Tenderers are not permitted to tender for a variant in addition to this tender.

3.Participation
Participation in the contract is open to legal entities (participating either individually or in a consortium of tenderers). Legal entities may not be in any of the exclusion situations mentioned in point 2.2.2 of the Civipol Guide to Procurement Procedures and Contract Award Rules.
4.Origin
The rule of origin is not applicable to this contract.
5.Currency
Tenders must be denominated in euros.
6.Lots
6.1The tenderer may bid for one or all lot.
6.2Each lot will be the subject of a separate contract and the quantities indicated for the different lot will be indivisible. The tenderer must offer all the quantity(ies) indicated for each lot. Partial bids will not be considered under any circumstances. If a tenderer wins several lots, a global contract covering all these lots may be concluded.
6.3Tenderers may state in their tenders the overall discount they are offering if they are awarded some or all of the batches for which they are submitting a tender.
6.4The contract will be awarded lot by lot, but Civipol may choose the most advantageous overall solution, considering the discounts granted.
7.Period of validity
Each tenderer remains bound by his tender for a period of 60 days from the deadline for submission of tenders.
8.Language of offers
Tenders, correspondence and tender-related documents exchanged between the tenderer and Civipol must be written in the language of the procedure, which is English. Where the accompanying documents provided by the tenderer are not in English, a translation should be attached.
9.Presentation of offers
9.1 Tenders must be received by the deadline specified in point 9.2. They must include all the documents specified in point 9 of these instructions and be sent to the following address procurementEU4FAST@experts.civipol.fr
Tenders must comply with the following conditions:
9.2All tenders must be received by email before 25st November 2024 at 12:00 Paris Time, by email to the address mentioned in 9.1. An acknowledgement of receipt indicating the number of emails received by the referred tenderer will be addressed with the date and time of receipt. The date and time of receipt by the contracting authority will be considered as the official date and time of submission, regardless when it was submitted by the tenderer.
9.3 All tenders, including annexes, and all supporting documents must be submitted by separated emails labelled as follows:

Please ensure that the attachment is not bigger than 7 Go per email.
Any modification or withdrawal of the bid submitted must be submitted before the deadline for submission of the bid, under the same conditions as indicated above.
10. Content of offers
All tenders submitted must comply with the requirements set out in the tender documents and include in particular:
Part 1:
Technical offer:
•A detailed description of the goods offered in accordance with the technical specifications (Annex II and III)
Part 2: The financial offer :
•A financial offer, calculated on a DDP2 basis, for the goods offered.(Annex IV) Part 3:
Documentation :
Must be supplied in any format:
•A description of the conditions of the guarantee in accordance with the conditions described in the general conditions of the supply contract.
•A description of the organisation of the product guarantee in accordance with the general conditions of the supply contract.
•Duly authorised signature: an official document (articles of association, power of attorney, notarised declaration, etc.) proving that the person signing is authorised to do so in the name and on behalf of the entity/joint venture/consortium.
To be supplied according to the templates provided:
•Financial Identification Form duly signed by the bank
•Legal Entity form, duly signed by the person authorized to sign on behalf of the entity, accompanied with supporting documentation

11. Pricing
11.1 Tenderers are deemed to have ensured, before submitting their tender(s), the accuracy and completeness of their tender(s), having considered all elements necessary for the full and correct implementation of the contract and having included all costs in their rates and prices.
11.2 Tenderers must calculate the unit prices (and overall prices) of their tenders on a DDP basis (Delivered Duty Paid: all costs are to be borne by the vendor).
11.3 The contract is based on firm, non-revisable prices, unless otherwise stipulated in the Special Conditions of the supply contract.
12.Additional information before the deadline for submission of tenders
Tenderers may send their questions in writing to the following address procurementEU4FAST@experts.civipol.fr no later than 10th november 2024 at 18:00 Paris time, specifying the contract title "MIGRAO-010-2024": Civipol has no obligation to provide clarification after this date.
Any clarifications to the tender documents will be published on https://ba.ekapija.com/tender and www.akta.ba no later than 15th November 2024 at 18:00 Paris time.
Potential bidders who seek to arrange individual meetings with Civipol during the tender period may be excluded from the tender process.
13. Information meeting or on-site visit
A virtual information meeting will be organised online on 31st October 2024 at 15:00 Paris time with a view to answering questions on the tender dossier sent in writing or raised at the meeting. Tenderers willing to attend the meeting should address their request to procurementEU4FAST@experts.civipol.fr so that they can be invited to participate in the virtual meeting. The minutes of the meeting will be published on https://ba.ekapija.com/tender and on www.akta.ba , or sent by email upon request when addressing the request to procurementEU4FAST@experts.civipol.fr - together with any clarification of written questions not raised at the meeting - no later than 15th November 2024 at 18:00 Paris time. No further clarification will be provided after this date. All costs associated with attending this meeting will be borne by the bidders.
14. Opening of tenders
14.1 Tenders will be opened online in public on 25st November 2024 at 15h00 Paris time via by the committee appointed for this purpose. Minutes will be taken by the committee and will be available on request. Tenderers willing to participate in the public opening should address their request to procurementEU4FAST@experts.civipol.fr so that they can be invited.
14.2 Any attempt by a tenderer to influence the evaluation committee in the procedure for examining, clarifying, evaluating and comparing tenders or to obtain information on the conduct of the procedure or to influence Civipol in its decision on the award of the contract will result in the immediate rejection of the tender.
15. Evaluation of offers
15.1 Examination of administrative compliance of tenders
The purpose of this phase is to check whether the bid complies in substance with the main requirements of the tender documents. A bid is considered compliant when it meets all the terms, conditions and specifications contained in the tender documents, without any significant deviation or restriction.
15.2 Technical assessment
After analysing the bids deemed administratively compliant, the evaluation committee will make a judgement on the technical compliance of each bid and classify the bids into two categories: compliant and technically non-compliant.
The minimum qualifications required must be assessed at this stage (see selection criteria in the contract notice).
15.3 Financial evaluation
a)Bids deemed technically compliant will be checked for arithmetical errors in calculations and totals. Errors will be corrected by the evaluation committee as follows:
-where there is a discrepancy between the amount stated in figures and the amount stated in words, the amount stated in words shall prevail;
-except for lump sum contracts, where there is a discrepancy between a unit price and the total amount obtained by multiplying this unit price by the quantity, the unit price indicated shall prevail.
b) The amounts thus corrected are enforceable against the tenderer. If the tenderer does not accept them, the tender is rejected.
15.4 Award criteria
The sole award criterion will be price. The contract will be awarded to the lowest compliant bid. 16. Signing the contract and performance guarantee
16.1 Successful tenderer will be informed in writing that its tender has been accepted (notification of the award of the contract). Prior to the signature of the contract between Civipol and the successful tenderer, the latter must provide the documentary evidence or declarations required by the legislation of the country where the company (or each company in the case of a consortium) is established, showing that it is not in one of the situations of exclusion provided for in point 2.2.2 of the Guide to Civipol's Procurement Procedures and Contract Award Rules. These proofs, declarations or documents must be dated within one year of the date of submission of the tender. In addition, the successful tenderer must submit a declaration stating that, since the date on which this evidence was drawn up, its situation has not changed.
16.2The successful tenderer must also produce evidence of its financial and economic situation and of its technical and professional capacity in accordance with the selection criteria as specified in the contract notice.
16.3If the successful tenderer does not provide these documents of proof or declarations or evidence of its financial and economic situation and its technical and professional capacity within 15 calendar days of notification of the award of the contract, or if it turns out that it has provided false information, the award of the contract will be considered null and void. In this case, Civipol may award the contract to the second lowest bidder or cancel the tender procedure.
16.4Within 15 days of receipt of the signed contract by Civipol, the successful tenderer must sign and return the contract with the performance bond (if applicable). Upon signature, the successful tenderer becomes the contract holder, and the contract comes into force.
16.5The performance bond referred to in the general conditions is set at 5% of the contract value and must be presented in accordance with the model annexed to the tender documents. It will be released within 15 days of the issue of the final acceptance certificate by Civipol, except for the part attributable to the after-sales service.
