Section III: Legal, economic, financial and technical information
1. As part of the bid, the economic operator should obligatory provide bid guarantee (participation guarantee) in the amount of at least 3 % of the total bid value without VAT.
2. A precondition for signing a contract with the most favourable economic operator shall be providing guarantee by the selected most favourable bidder for quality performance of the contract in the amount of 15 % of the contract value.
2.2.1 The National bank of the Republic of Macedonia shall exclude from the procedure for awarding contract for public procurement every economic operator:
— against which legally effective court decision for participation in criminal organization, corruption, fraud or money laundering in the last 5 years is stated;
— against which an additional penalty — ban on participation in open invitation procedures, awarding contracts for public procurement and contracts for public private partnership, is stated;
— against which an additional penalty — temporary or permanent ban on performing certain activity, is stated;
— that is in a bankruptcy or liquidation procedure;
— that has unpaid taxes, contributions or other public fees, unless the economic operator has been authorized a deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and are regularly paid;
— against which misdemeanor sanction — ban on performing profession, activity, duty, i.e. temporary ban on performing certain activity is stated, and
— that gives false information, or fails to submit the data required by the Contracting authority.
2.2.2 For proving its personal standing, the economic operator shall submit the following documents:
— statement of the economic operator showing that it has not been stated any legally effective court decision for participation in criminal organization, corruption, fraud or money laundering in the last 5 years;
— certificate issued by a competent body stating that no bankruptcy procedure has been instigated;
— certificate issued by a competent body stating that no liquidation procedure has been instigated;
— certificate issued by a competent body in the domicile country of taxes, contributions and other public fees being paid, and
— certificate that it has not been stated an additional penalty — ban on participation in open invitation procedures, awarding contracts for public procurement and contracts for public private partnership issued by the Registry for penalties for criminal acts committed by legal entities;
— certificate that it has not been stated an additional penalty — temporary or permanent ban on performing certain activity, issued by the Registry for penalties for criminal acts committed by legal entities;
— confirmation that it has not been stated any legally effective misdemeanor sanction ban on performing profession, business activity or duty, i.e. temporary ban on performing certain activity.
2.3. Capability for performing professional activity.
2.3.1 In order to prove the capability for performing professional activity, the economic operator should submit document for registered activity as a proof that it is registered as a natural person, or legal entity to perform the activity related to the subject of the contract for public procurement, or proof that it is a member of an adequate professional association, according to the regulations enforced in the domicile country.
Section IV: Procedure
Additional information about electronic auction: 1.4 Type of procedure for awarding a Contract for Public Procurement.
1.4.1 The Contract for Public Procurement shall be awarded by applying an open procedure, which will end with an electronic auction as the last stage in the procedure.
1.4.2 This procedure shall not be conducted by using electronic means through the Electronic System for Public Procurement (ESPP), except in the part of electronic auction, which is mandatorily conducted through the ESPP (https://www.e-nabavki.gov.mk).
1.4.3 More information on the use of electronic devices shall mean: To be able to participate in the electronic auction, you need to register in the ESPP. Registration in the ESPP is free. The economic operator shall register in the ESPP by completing the registration form, which is an integral part of the ESPP. After that, the ESPP automatically processes the data from the registration form, generates a code, and submits it to the registered e-mail address of the economic operator. More information on how to register and use the system you will find in the Instructions for economic operators, which you can download from the homepage of ESPP in the section ‘Economic operators’.1.4.4 More information on the electronic auction: The contracting authority will use the electronic auction as the last stage in the open procedure. Subject of electronic auction is the total price including all costs and discounts and import duties, VAT excluded. The initial electronic auction price is the lowest price of the accepted bids submitted in the initial stage of the procedure for each part separately. Invitations to participate in the auction will be submitted electronically through the ESPP after full evaluation of the initial bids, to all economic operators who submitted acceptable bids in the first stage of the procedure and who are registered in the ESPP.
The invitation for participation in the auction shall be sent electronically to the e-mail address of the contact person stated in the Bid form who is previously registered in the ESPP.
The invitation to participate in the auction shall include the following data: the initial price of the auction, i.e. the lowest price of the initially submitted bids; the beginning and ending date and time of the auction, as well as the interval in which the negative bidding will be held (minimum and maximum difference in the bid prices).
If only 1 bid is submitted, or there is only one acceptable bid, the e-auction shall not be held, and the Contracting authority shall invite the single bidder to submit final price through the ESPP. The invitation for submitting final price shall have the following data: identification of part of the bid that will be subject of submission of the final price, information that will be available before submitting the final price and the time-frame for submitting the final price. The single bidder shall submit the final price in the set time only once, and if it fails to submit the final price, the preliminary set price shall be considered final.
