Consultancy Services

Invitation for Expressions of Interest

The government of Republic of Croatia (RH) and Council of Ministries of Bosnia and Herzegovina (BiH) signed a Treaty on Construction of Interstate Bridge over Sava River (the Bridge) near Gradiska. RH and BiH shall bear the cost of the Bridge construction and supervision of works jointly as per the Treaty. Ministry of Transport and communication (the Employer) will be responsible for implementation of the project’s consultancy services – supervision of works. The State of Bosnia and Herzegovina has signed the Grant Agreement (The Grant) with the European Investment Bank (The Bank) to support the financing of construction of the Bridge. Bosnia and Herzegovina (BiH) shall spend part of the Grant amount through Ministry of Transport and Communications of BiH for consultancy services — Supervision of the works while the remaining part of the Grant shall be spent for construction works. The service contract shall be financed by a grant made available by the Western Balkans Investment Framework (WBIF) and administered through the European Investment Bank (the Bank).

The works will include following components:

— access road to the bridge (expressway typical cross-section) on Croatian side in total length of 50,79m (shall be financed 100 % by Croatian side),

— interstate bridge over Sava river (expressway typical cross-section) in total length of 462,25m (shall be finance by RH and BiH, 50 % each),

— access road to the bridge (motorway typical cross-section) on BiH side in total length of 411,54 m (shall be financed 100 % by BiH side).

The main objective of the assignment shall be to perform the duties and assume the authority of “the Engineer” in accordance with the contract conditions which will be based upon the “Conditions of Contract for Construction” (FIDIC, Red Book), First Edition 1999, published by the Fédération Internationale des Ingénieurs-Conseils (FIDIC), and, in respect of contract administration procedures, ensure compliance with EIB Guide to Procurement (June 2011).

The consultant shall also act in the role of the Engineer and its outputs shall have to comply with the Construction permit, respectively the Main Design, applicable legislation effective in both countries i.e. Republic of Croatia (Construction Law – NN 153/2013 and NN 20/2017, Rulebook on the way of implementation of the supervision of the works, Form and conditions of the site diary conduction, Resident Engineer final report content – NN 111/2014, 107/2015) and Bosnia and Herzegovina (Republic of Srpska Construction law, Rulebook on the way of implementation of the works supervision during construction phase, Guidelines for road design, construction, maintenance and supervision – Sarajevo/Banja Luka, 2005, Environmental Protection Law in the Republic of Srpska) and all other relevant laws and regulations.

The construction supervision services shall also include, but not be limited to, the following:

— undertake the duties of the “Engineer”, as required by the relevant clauses of FIDIC, Red Book and the particular contract conditions as determined within the Construction Contracts,

The assignment is expected to start in 1st half of 2019 and last about 30 months (896 calendar days) + DNP period. Total value of construction works for the bridge is estimated on EUR 29,5 million (29 500 000,00 EUR) and the approximate value of Supervision services for the Bridge is EUR 1 million (1 000 000,00 EUR).

Consulting firms from any country are eligible for short listing and selection.

Interested firms are hereby invited to submit expressions of interest. A short list up to 6 (six) qualified firms will be formally invited based on criteria set bellow to submit proposals following this invitation. The winning company or JVCA will be obliged by the time of the Contract signature to obtain all relevant licences and permits required by the laws of Republic of Croatia and Bosnia and Herzegovina necessary to carry out the services (both companies and individual). In order to determine the capability and experience of consulting firms seeking to be short listed, the information submitted shall include the following:

— letter of application,

— company profile: name, status, address, telephone number, facsimile number, year of establishment, contact person for the project, e-mail of contact person, number of permanent staff and part-timers, fields of expertise,

— applicant’s average annual turnover for the previous 3 (three) years and copy of available audited Financial statement for last 3 (three) years. The available audited financial statement for the past 3 (three) years must demonstrate the soundness of the applicant’s financial position, showing long-term profitability,

— details of experience and description of assignments of an equivalent nature undertaken in the previous 10 (ten) years, including the contract’s value and location, number of staff involved in the contract, name of the Client, name of partners for contract execution, source of financing, type of services provided, contract commencement and completion dates, brief description of the contract. Any available reference letters from Employers of completed contracts should also be submitted,

— CVs (max. 2 pages each) of key staff who could be available to work on the assignment, clearly showing that their experience covers the main works activities above; positions should minimally include the following:

—— Resident Engineer

—— Deputy Resident Engineers

—— construction works experts [steel or composite steel-concrete span structure construction, geotechnical, roads, electrical, geodetic, etc.]

—— materials experts

—— contracts/financial experts

— form of association (sub-contractor / joint venture) for the execution of the contract, if the case may be, and the lead company. The same information as for the lead company shall be requested for the associated company/companies;

— a list of on-going contracts including the start date, the end date and the personnel involved.

— the Consultant shall have experience in implementation of minimum 1 (one) bridge construction supervision contracts in accordance with FIDIC Red Conditions, in the last 10 (ten) years implemented on construction of the road or railway bridge with steel or composite steel-concrete span structure with minimum interior span of 200 m.

— the Consultant shall have experience in implementation of minimum 1 (one) motorway.

Construction supervision contracts in accordance with FIDIC Red Conditions, in the last 10 (ten) years implemented on construction of motorways/expressways.

— the Consultant shall have average annual turnover of the applicant for the past 3 years (three) must exceed EUR 1.0 million; and

— in case of Joint Venture C’1onsortium and Association, the Leading Company shall meet not less than 60 % and other partners shall meet not less than 25 % of the qualifying financial criteria given above.

The above information should not exceed 25 pages excluding CVs.

Evaluation criteria of EOIs:

1) Company Profile and general experience- 40 %,

2) Particular Experience - 40 %, experience as a Consultant under similar assignments (Red Fidic type of Contracts) related to supervision of Bridge construction,

3) Access to qualified experts: - 20 %,

To demonstrate access to qualified experts the Consultants shall provide at least one CV for each position required for the implementation of the contract, as indicated above.

Procurement procedure: Procurement of the consultancy services will be conducted through the procedures as specified in the EIBs Guide to Procurement – June 2011.

One shortlist of qualified firms will be prepared on the response to this invitation, after which short-listed firms will be invited to submit their Technical and Financial proposals. A firm will be selected from shortlist based on quality and cost based criteria defined in the Request for Proposals.

If the Consultant has been found by a judicial process or other official enquiry to have engaged in any of the Prohibited Practices as defined in EIBs Guide to Procurement – June 2011, details of the basis for the outcome of such process or enquiry shall be provided with the expression of interest.

The Employer reserves the right not to shortlist consulting firms that have been found to have engaged in any of the Prohibited Practices regardless of the results of technical evaluation of the expressions of interest.

If there is a party with an interest in the contract and who has been or who risks being harmed by an alleged infringement of the procedure, then such party may:

— in a first step, address any request for review to the Employer; and

— in a possible second step if still not satisfied by the response of the Employer, address any request for review to a committee to be established within Counsel of Ministries of Bosnia and Herzegovina comprising [3] qualified and independent persons, who are empowered to enforce on the Employer such action as necessary to ensure compliance with the applicable rules in a timely manner.
